Terms and conditions
These terms apply to all orders placed by consumers and businesses in the online shop of CHERGUI GROUP LTD.

§ 1 Scope
The following terms apply to all orders placed through this online shop. Differing terms put forward by the customer do not form part of the contract unless we expressly agree to them.
A consumer is any natural person entering into a legal transaction for purposes that are predominantly outside their trade, business or profession.
§ 2 Contracting party and formation of contract
The contract of sale is concluded with CHERGUI GROUP LTD, 205 Regent Street, W1B 4HB London, England, Company No. 16434669.
The presentation of products in the online shop is not a legally binding offer but an invitation to place an order. By submitting your order with the “Place order and pay” button you make a binding offer. The contract comes into effect once we declare acceptance by sending an order confirmation by email. An automatic acknowledgement of receipt does not yet constitute acceptance.
§ 3 Prices and delivery costs
All prices are final prices in euros and include statutory VAT. Delivery costs of €5.90 are added; from an order value of €49.00 we deliver free of charge.
§ 4 Delivery
We deliver to Germany, Austria, Switzerland, Netherlands, Belgium. Delivery takes 2–4 working days from receipt of payment, unless the product page states otherwise. Part deliveries are permitted where this is reasonable for you; they incur no additional delivery costs.
§ 5 Payment
Payment is made in advance by bank transfer. You receive our bank details and your order number as the payment reference with the order confirmation. The goods are dispatched once payment has been received in full. Further payment methods will be added once the payment service provider is activated.
§ 6 Retention of title
The goods remain our property until they have been paid for in full.
§ 7 Right of withdrawal
Consumers have a statutory right of withdrawal. The details and the model form are set out in our cancellation policy. On top of that we voluntarily grant a right of return of 30 days.
§ 8 Warranty and guarantee
Statutory liability for defects applies. In addition we grant a manufacturer's guarantee of 3 years from the date of purchase on every appliance. The guarantee covers material and manufacturing faults; wearing parts and damage caused by improper handling are excluded. Statutory rights are not limited by the guarantee.
§ 9 Liability
We are liable without limitation in cases of intent and gross negligence, and for injury to life, body or health. In the case of slightly negligent breach of essential contractual obligations, liability is limited to the foreseeable damage typical of the contract. Liability is otherwise excluded. Liability under product liability law remains unaffected.
§ 10 Old appliances and batteries
Waste electrical appliances do not belong in household waste. You can hand old appliances in at municipal collection points free of charge. Batteries and rechargeable cells must be returned to the designated collection points.
§ 11 Dispute resolution and final provisions
We do not take part in dispute resolution proceedings before a consumer arbitration board. Should individual provisions of these terms be invalid, the remainder of the contract stays in force. Mandatory consumer protection provisions of the state in which a consumer habitually resides continue to apply.
